Drug Offences

What should you know after a possession or trafficking charge?

How the drugs were found is often more important than what was found. Search and detention issues under the Charter are the most common basis for excluding evidence in drug cases, which is why the circumstances of the stop or search matter enormously — and why you should describe them to a lawyer rather than to police.

What to do next

  1. Say nothing and ask for counsel

Do not explain ownership, purpose or quantity. Ask for a lawyer and exercise your right to silence. Statements about whose drugs they were are the most damaging evidence in these prosecutions.

  2. Record exactly how the search happened

Where you were, what was said, whether you were told you were detained, whether consent was asked for or assumed, whether a warrant was shown, and how long it took. This is the raw material for a Charter application.

  3. Understand the difference the allegation makes

Simple possession, possession for the purpose of trafficking, and production or importing are very different in exposure. What elevates a charge is often quantity, packaging, scales, cash and messages — not just the substance.

  4. Ask about diversion and treatment routes

For simple possession, diversion or treatment-based resolutions are available in many jurisdictions, and Toronto operates a Drug Treatment Court. These can avoid a conviction entirely — ask defence counsel whether you qualify.

Frequently asked questions

They found drugs in a car I was in — is that possession?

Possession requires knowledge and control, which is genuinely contested in shared-space cases. Do not concede it in a statement; it is a legal question for your lawyer.

Can evidence be excluded if the search was improper?

Yes. Charter breaches in detention or search are the most common route to excluding evidence in drug cases, which is why the circumstances matter so much.

Is cannabis still a criminal matter?

Legal possession has limits on amount, age and source. Exceeding them, or selling outside the licensed system, remains an offence.

Will this affect travel to the US?

It can, including charges without conviction. Raise border and immigration consequences with counsel before resolving anything.

This is general information, not legal advice. Laws vary by location and every situation is different — speak with a qualified lawyer about your specific circumstances.
